Business Terms of Service

These terms apply to SemsTrend subscriptions bought in US dollars by businesses outside Türkiye. Customers in Türkiye buy under the Turkish pre-contract information form and distance sales contract (https://www.semstrend.app/legal/mesafeli-satis). 1. BUSINESS CUSTOMERS ONLY USD plans are sold only to companies and other businesses acting for commercial purposes. By subscribing you confirm that you are not buying as a consumer. 3. SERVICE SemsTrend is a software-as-a-service tool that scores products in selected Amazon categories by TikTok creator momentum and Google search volume in Türkiye and Germany. Your plan sets the number of categories, the live data refresh cadence, the daily run limit (fair use) and access to the wholesale price view. Results are statistical signals, not business, investment or legal advice; you remain responsible for your product and sales decisions. 4. PRICES, TAXES AND PAYMENT • Starter: $39 a month or $390 a year • Pro: $99 a month or $990 a year • Business: $249 a month or $2,490 a year • Enterprise: by quote and contract, from $999 a month • Prices exclude VAT and other taxes. You are responsible for any VAT, withholding or similar tax that applies in your country. • Yearly plans cost ten times the monthly price (two months free). • Fees are paid in advance for each billing period through a licensed payment service provider; card details never reach our servers. Enterprise plans are invoiced under their contract. • We may change list prices with at least 30 days' notice for monthly plans. A yearly price stays fixed for its term. 5. TERM, RENEWAL AND CANCELLATION • Monthly and yearly subscriptions renew automatically for the same period until cancelled. • You can cancel at any time from your account or by email. Cancellation takes effect at the end of the current billing period, and access continues until then. • Fees already paid are not refunded, except for billing errors or where the law requires a refund. • We may suspend or terminate access for account sharing, automated abuse, bulk copying of data or unlawful use. 6. FAIR USE Accounts are personal and may not be shared. Daily run limits apply per plan. You may not scrape the service, resell its data as a dataset or try to bypass plan limits. 7. DATA SOURCES AND AVAILABILITY Live refreshes depend on third-party data sources. If a source is unavailable, the last successful data is shown and we work to restore normal service within a reasonable time. Plan refresh cadences and daily run limits are maximums for normal use (fair use). We run a monthly data budget to control data-provider costs and size it to deliver every active plan's refresh cadence under normal use. If unusual or abusive use, or an unexpected increase in data-provider prices, exhausts the budget, live refreshes may pause until the start of the next calendar month at the latest; during a pause the last successful data is shown with its date and the app tells you about the pause. No specific uptime is guaranteed unless an Enterprise contract says otherwise. 8. INTELLECTUAL PROPERTY All rights in the service, the SemsTrend brand and its algorithms are reserved. You may use exports internally in your business. 9. LIABILITY To the extent the law permits, our total liability under these terms is limited to the fees you paid in the 12 months before the claim, and we are not liable for indirect or consequential losses, including lost profits. Nothing in these terms limits liability that cannot be limited by law, such as liability for intent or gross negligence. 10. GOVERNING LAW AND JURISDICTION These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara (Central) have jurisdiction. 12. CHANGES We may update these terms with at least 30 days' notice by email. Continued use after the effective date means you accept the update.
